Kentucky’s lawsuit system performs poorly. Business litigators surveyed in 2017 ranked Kentucky 42nd in the nation at producing fair and reasonable justice. It is well behind its neighbors in providing fair and predictable justice that safeguards individual liberty
and buttresses economic opportunity. Between having no limitations on noneconomic damages and multiple barriers to jury service, there is quite a lot of room for improvement in Kentucky’s lawsuit system.

NERA Economic Consulting completed a study quantifying the economic impact of passing a bevy of lawsuit reforms. According to the report, passage of a complete package of lawsuit reforms could increase employment in Louisiana between 1.03 and 2.79%.
