The contract must establish the reasonable hourly rate for each attorney that performs the work. These rates cannot exceed $1,000 per hour. The base fee of all those who worked on the matter is subject to a multiplier, set by contract, that may not exceed 4 without legislative approval, that reflects the difficulty of the case, risk of not recovering litigation expenses, and risk of no recovery. The contract must also limit the contingency fee to a stated percentage of the recovery, not to exceed 35% without legislative approval. The private firm's compensation is the lesser of the computed fee/multiplier or the percentage of the amount recovered.
