South Carolina’s lawsuit system is a poor performer. Business litigators surveyed in 2015 ranked South Carolina 36th in the nation at producing fair and reasonable justice. South Carolina has been successful with a handful of improvements to their lawsuit laws, but significant reform is still needed in dealing with product liability lawsuits and government contracts with private attorneys.

NERA Economic Consulting completed a study quantifying the economic impact of passing a bevy of lawsuit reforms. According to the report, passage of a complete package of lawsuit reforms could increase employment in South Carolina between 0.71 and 1.93%.
